Sohar celebrates royal pardons

Yesterday was Renaissance Day in Oman. HM Sultan Qaboos issued royal pardons to 'all those convicted in riot cases, or who had resorted to violence and prevented authorities from carrying out their duties, caused inconvenience to public, intentionally hampered traffic, set fire to government institutions, vandalised public property, and possessed explosives,' which covers many of the protestors who rioted two years ago in Sohar. In total, 139 Omani nationals were released nationwide. In reaction, shabab from Sohar slaughtered cows as sacrifice in gratitude and paraded in their vehicles.

Oman when/if the seas rise due to climate change

 it looks as if you will be under water.


Recently, I read a 'scientific' article reporting the CO2 level is now as concentrated in the atmosphere as when the seas were 40 meters higher; and that more melting action down in Antarctica was going on. Supposedly, the rise in ocean level will happen rapidly.  If the seas did raise 40 meters, this is what Oman would look like.

Please refer to maps below. The 'yellow' indicates about a 20 meter raise in sea level. The red areas indicate a severe flooding problem with a one to six meter level rise. The green areas will probably be OK unless the seas rise 35-70m. Oman looks alright except for the coastal cities. The interior people behind the Hajer mountains have nothing to worry about. Should the capital be moved back to Nizwa?

In Muscat, the area between the coast and Sultan Qaboos Highway is coloured in 'red' and in the danger zone for only a one to six meter rise in sea level. This part of Muscat looks doomed; which includes the new airport. Places like Ansab and Al Khoud look above water with a 20m rise. Maybe, the powers that be should start to build these new billion dollars projects a bit inland just in case; and, while they are at it cancel the new coastal road up to Shinas from Muscat as the water may creep in before they finish if the 'scientific projections' prove correct.

Sur will be destroyed; but Masira makes it. Part of Salalah goes under water, but some of it survives. Over in the UAE, Dubai and Abu Dhabi are in the 'dark red zone' and get flooded.

Sohar: Omani man blocks highway asking the government to help him out

Yesterday, a 50 year-old man accompanied by his daughter blocked the main road of the wilayat of Sohar with his truck causing traffic for hours. He was demanding the government help him and his family with financial issues.

His electricity and water have been shut off by the local power company. He said he has been asking the government for financial help for the past 30 years, but no response has been received so far. We wish this guy the best and that he finds relief from his troubles.

Wild Hybrid Cats spotted in Musandam

No comments:

This wild cat is found in Busa area in Musandam and in Salalah-- Rumors in social networks said that a leopard. It's untrue.

A team from Ministry of Environment said that it's a hybrid wild cat, long tail and ears, predation teeth and in extreme danger of extinction. It has the same characters of lynx.

Oman Law Blogs

    • This blog is put out by Curtis, Mallet-Prevost, Colt & Mosle LLP, a leading American law firm out of New York founded in 1830. Curtis maintains a law office in Muscat.  One can find articles describing the particulars on a range of legal topics such as employment law, integrated tourist complexes (ITC), entity formation in Oman, various regulations, etc.
    • This blog has some nice write-ups on the emerging legal issues in regard to the internet in Oman, defamation and various other topics. It's a quite interesting read on the differences between European based law and Omani law relative to these issues. It is run by an Omani lawyer according to his profile.

Notes: Foreign (non-Omani) lawyers may only practice in Oman if given permission by the Department of Justice in Oman. Normally, a foreign lawyer must have ten (10) years experience before permission will be granted. To the best of my understanding, foreign law firms must now (which may not have been the case previously) be partnered with an Omani firm to open an office locally.

        1. Article (35) Every foreigner who is legally resident in the Sultanate shall have the right to protection of his person and his property in accordance with the Law. Foreigners shall have regard for society’s values and respect its traditions and customs.
        2. Article (36) Extradition of political refugees is prohibited. Extradition of criminals is subject to the provisions of international laws and agreements.

    1. The labour law may be of interest to the many expats residing and working here in Oman.  Make sure you have the most updated copy as there have been some changes to the law in the last couple of years. I put together a section on how to file a complaint with Manpower further below.

    3. In 2012, Oman joined the Hague Convention which means there is no need of further legalization of documents at the Omani Consulate if your documents have been affixed with an apostille in your country, and your country is also a member of the Convention.

    3. A few notes about licenses and driving. A foreigner may drive on an international or foreign license on a tourist or visitor visa for up to three months. Then, if they become legal residents should switch over (as required by law) to an Omani license. Realistically, one may be able to drive a rental car or company car (red plates) on a foreign license indefinitely. A foreigner can register up to three cars, but needs residency and an Omani license to do so. Also, if you have an accident keep the cars blocking the road as this is the procedure until the police arrive.
    4. Licenses for foreigners:
      The countries below are exempted from taking the driving test and can trade in their foreign license for an Omani license if :
      1. you are legally residing in Oman, at least 18 years old, and have been licensed at least one year (your foreign license must reflect this; so, if you renew back home and the renewed license shows a date of having a license for less than one year, you may run into problems).
      2. and you are from one of these countries (Notice the complete lack of South American countries) :
(a) The Gulf co operative
council countries.
(b) Jordan.
(c) United Kingdom, France, Holland, Germany, Italy,
Belgium, Spain, Switzerland, Austria, Luxembourg,

How to file a labour complaint with Manpower in Oman.
I am going to write a little about the process of filing a complaint at Manpower at least from my experience. But, first a quick disclaimer: this is for informational purposes only not legal advice and should not be taken as so. Please seek advice from a competent legal authority.

In order to file a complaint with Manpower in Muscat, one must go to the Manpower building in Ruwi (NOT the Seeb location). This building is located next to the Badr Sam’a Hospital near the Ruwi roundabout. This building is also used as a ‘quasi jail’ or holding area for the illegal workers who are rounded up each week.

The complaint office is on the second floor; the legal office is just down the hall from the complaint office. Before you go to Manpower make sure Manpower is the correct body to complain to based upon your employer type.

The building is a bit dilapidated and not well marked for non-Arabic speakers. The English level of the many employees is marginal, so it is best to go with an Arabic speaking person. Also, the complaint must be written in Arabic.

The clerk will give you a standard one page form (written in Arabic) to fill out. Naturally, bring your labour card and contract.  Think how difficult a process this is for the low-wage and under-educated labourer who doesn’t speak or write Arabic and has been shafted by an employer. After your complaint is filed, the Manpower office will send a letter to your employer with your claims.

Also, please note according to the regulations, the first step before filing a complaint is one must make attempt to settle the matter using the employer’s procedure if they have one.  It is highly advisable to make all communications with the employer in a documented way such as in writing.  It seems oral efforts can always be ‘not remembered’.  Again, BE WARY of verbal promises and comments as it seems western culture draws different expectations from oral promises than Omani. The provisions of the contract and the Omani law weigh heavily. There are also
time bars to filing certain complaints such as dismissal, so if you are serious about filing take heed or seek the proper legal advice.

In addition, there will be one or several mediation sessions that are supposed to take place about two weeks after one files a complaint before the case makes it to any sort of court. The meditator does get back to the judge and has sway, so it is somewhat different than say American style mediation.

Keep in mind this process can take a while so be prepared to stay around for months. Hearings are often postponed and consider Ramadan in your timings.  Finally, it seems to me the labour law provisions are favourable towards employees.
